Anesthesia and the No Surprises Act

Why anesthesia groups are among the specialties most affected by the No Surprises Act, how payments are disputed, and what groups should track.

Short answerAnesthesia is a core specialty covered by the No Surprises Act: patients usually can't choose their anesthesiologist, so out-of-network anesthesia at in-network facilities can't be balance billed for most patients, and the notice-and-consent exception doesn't apply. Groups contest low payments through open negotiation and federal IDR.

Anesthesia groups felt the No Surprises Act more than most specialties, because so much of their work happens at facilities they don't control.

Why anesthesia is different

  • patients rarely choose their anesthesia provider
  • anesthesia is one of the ancillary services where out-of-network providers can't use the notice-and-consent exception to balance bill
  • payment is formula-based, so a low conversion factor repeats on every case

What groups should track

ItemWhy
Network status at each facilityDetermines whether NSA rules apply
Out-of-network payments by planStarts the 30-business-day negotiation clock
Units and conversion factor paidBasis for the dispute
Plan type (self-funded vs fully insured)Federal vs state process

The dispute path

  1. initial payment, often near the QPA
  2. open negotiation within 30 business days
  3. federal IDR within 4 business days after negotiation ends
  4. offers with evidence: training, acuity, case mix, prior rates
